SHC rejects the stay order appeals of Zardari and Talpoor

Court (SHC) rejected the stay order appeals on Monday of the previous President
Asif Ali Zardari and his sister Faryal Talpoor regarding the Banking Court’s
decision to shift the fake accounts case to Islamabad after hearing the
concerns.
Farooq H. Naek appeared on the behalf of Ex-president and his sister before
the divisional bench which consists of two judges, the SHC Chief Justice,
Justice Ahmed Ali M. Sheikh and Justice Omer Siyal. Zardari also appeared
before the SHC.
The Chief
Justice asked Farooq H. Naek during the hearing that, “if you think, what is
going on, is wrong. Then, why you should not file a reference of review in the
Supreme Court?”
Farooq Naek put his viewpoints before the court that, “the chairman of NAB
filed a reference in banking court regarding the shifting of case, while the
Chief Justice of Pakistan was never asked for transfer of case, the NAB
interpreted on wrong way the Supreme Court’s decision”.
The Chief Justice asked Naek that, “what is your case? This is the SC’s
decision, what is your opinion about the SC’s decision?”. Mr. Farooq replied
on, that in paragraph 300 there is no demands of SC for the transfer of case to
Rawalpindi”.
The Chief Justice again asked a question to H. Naek that, “if u think that
the situation is against you, then why are you not filing a petition of review
in the SC?”. What else there after SC’s decision? According to which
legislation the NAB can proffer the additional challan?
Zardari’s Lawyer replied that, “this is not the case, when the supreme
court took care of the petitions then the NAB’s chairman filed a reference in
banking court”. Farooq Naek requested before the court for providing the whole
record about the case, the court rejected the lawyer’s verbal plea.
The Court passed the remarks that, “after listening to the parties, the
order will decide on the situation”. The Court issued a notice to NAB to appear
before on March 26.
SHC passed
the remarks that, “after listening to the parties, the order will be issue on
the situation”. While the court accepted the appendixes of Zardari and his
Sister Faryal for 10 days.
On the other hand, Asif Ali Zardari challenged the call up notice of NAB in
the high court. NAB summoned Asif Zardari and Bilawal Bhutto Zardari to appear
on March 20.
Ex-president
Asif Zardari said two lines of poetry on the occasion of signing the appendix
papers, “kiyu phirte ho udaas sardiyo Ki shamo mein, is Tarah to hota Hai is
Tarah k kamo mein”, which means, “Why do you go the cold winter? So, it happens
in such tasks”.
